Man Arrested On Five Counts of Assault on Law Enforcement Officer with Firearm Among Other Charges

PRESS RELEASE – On December 1, 2025 Deputies with Cherokee County Sheriff’s Office assisted by Officers from Andrews Police Department responded to 115 LJ Moss Ln in the Marble community. Deputies were attempting to serve a warrant for Felony Larceny on Levi Charles Moss. Upon arrival, deputies made multiple attempts to get Moss to exit the residence and a standoff ensued when Moss refused those requests.

Deputies were then able to contact Moss by phone and continue attempts to get him to exit the residence. The deputy speaking with Moss on the phone could hear what sounded like the loading and chambering a shotgun. As more officers arrived on scene, Moss began pacing back and forth through the residence and was carrying what appeared to be a gun. Moss then began covering up the windows to the residence with blankets to obstruct the deputies view into the residence. Deputies continued to give call outs for Moss to put away the firearm and exit the residence but he still refused to comply.

While deputies were still trying to talk Moss into coming out on to the front porch, Moss attempted to sneak out a rear window of the residence. Upon doing so, he was met by two officers and a taser was deployed but was ineffective in apprehending Moss. Moss was able to get back through the bedroom window and then fired three shots from what was believed to be a pistol.

After an approximately 3-hour standoff, deputies were able to place Mr. Moss into custody with no injuries to Moss or the Officers. After Mr. Moss’s arrest, a search warrant was executed on the residence.

Moss was charged with the following offenses:
• Felony Larceny
• Possession of Methamphetamine
• Possession of Drug Paraphernalia
• Five counts of Assault on Law Enforcement Officer with Firearm,
• Two counts of Assault with a Deadly Weapon.

Moss was presented before a North Carolina Magistrate and initially received no bond. He has since been given a bond and is currently confined in the Cherokee County Detention Center under a $760,000.00 secured bond.

All suspects are considered innocent until proven guilty in a court of law.
