Clarkesville Man Arrested on Multiple Frauds

Murphy, NC—The Cherokee County Sheriff’s Office reports the December 11, 2021 arrest of Robert James Allen, a 63 year old male who listed a Clarksville Georgia address for numerous fraud charges as well as fugitive from justice.
In July 2021, the Cherokee County Sheriff’s Office began a joint investigation with the Clay County Sheriff’s Office into allegations that Allen had fraudulently used the checking account of a deceased person to obtain funds from local businesses in Cherokee and Clay counties in North Carolina.
This particular investigation involved several thousand dollars of loss to a local merchants where Allen had cashed the checks. The investigation revealed that Allen has a past history of obtaining funds by fraud in North Carolina, Oklahoma and Georgia and was currently wanted in other states on similar charges which he apparently fled from.
Allen is currently in the Cherokee County Detention Center on a $90,000.00 secure bond for the following charges: FORGERY OF INSTRUMENT X 3, UTTERING FORGED INSTRUMENT X3, OBTAIN PROPERTY FALSE PRETENSE X 3, and EXTRADITION/FUGITIVE OTHER STATE X 3. Allen’s Cherokee County Court date is January 13, 2022.
Chief Deputy Joe Wood stated “Great team work by Cherokee and Clay County Sheriff’s Offices in getting Allen to justice. As mentioned this is not the first time Allen has been charged with these particular charges.”

Murphy Man Arrested for Secretly Peeping

Murphy, NC—The Cherokee County Sheriff’s Office reports the December 10, 2021 arrest of Shawn Michael Robinson, a 34 year old male of Murphy North Carolina for Child Sex Charges and Secretly Videoing a Child.
In August 2018, the Cherokee County Sheriff’s Office began an investigation into an allegation in which Shawn Robinson had secretly placed a cell phone and videoed a minor female in the bathroom of the residence they occupied in the Peachtree Community of Cherokee County North Carolina. Because Robinson was residing in the residence as the victim the Cherokee County Department of Social Services as well as HAVEN Child Advocacy Center were called upon to assist in the investigation.
During the investigation numerous search warrants were obtained to seize and examine computers, cellular phones and various social media accounts belonging to Robinson. During the examination of the computers the assistance of the North Carolina State Bureau of Investigation Crime Lab was requested. Due to a backlog of cases from other agencies in the state the examination took approximately a year to retrieve the evidence from the electronics.
In January of 2021 the case was submitted to the Cherokee County Grand Jury which issued indictments for two counts of Indecent Liberties with a child and two counts of Secret Peeping. At the time the warrants were issued Robinson had moved from his Cherokee County Residence.
On December 10, 2021 Graham County DSS who is now assisting in the investigation of the case made contact with the Cherokee County Sheriff’s Office and provided an address in Clay County North Carolina where Robinson was believed to be living. With the assistance of the Clay County Sheriff’s Office Robinson was arrested at a Mission Dam Road residence without incident. It was later found out that Robinson had moved back into the residence where the victim was living.
Robinson was arrested and taken to the Cherokee County Detention center and placed under a $80,000.00 secure bond. Robinson is presently out on bond and expected to be in Cherokee County Superior Court on 02/21/2022

Absconding Sex Offender Captured

Murphy, NC—Sheriff Derrick Palmer reports the December 01, 2021 arrest of convicted sex offender Justin Ryan Barber, a 32 year old male of Murphy North Carolina for Violation of the North Carolina Sex Offender registry as well as multiple charges including theft and failure to appear.
In January 2008, Justin Barber plead guilty of the crime of Incest in Cherokee County Superior Court. In accordance with the North Carolina General Statutes governing the registration of offenders convicted of sexual offenses, Barber registered with the Cherokee County Sheriff’s Office shortly after the conviction in January 2008. One of the duties that Barber was required by statute to abide by was to notify the registering sheriff of any changes of address.
In January 2021, Barber personally appeared at the Cherokee County Sheriff’s Office and made a change of address indicating that he was residing at a residence on Indian Hills drive, Murphy North Carolina.
In March of 2021, while an investigation was being conducted into the theft of several high value coins, information was made known that Barber was no longer at the residence. Attempts were made to locate Barber in Cherokee County. A warrant was issued for Barber’s arrest for failing to notify his change of address. Additionally, assistance was requested with the United States Marshal Service, and the North Carolina Department of Community Corrections to assist in locating Barber. Additionally, the warrant for Barber’s Failure to Report his address change was entered into NCIC with Nationwide Pickup.
In late October 2021, the detective assigned to the case was notified by the officials in Gennessee County NY that Barber was in their jurisdiction. Once the warrant for arrest was confirmed Barber was incarcerated at the Gennessee County Detention Center.
Barber waived Extradition and Deputies of the Cherokee County Sheriff’s Office made the trip to Gennessee County NY and returned Barber to the Cherokee County Detention Center.
Barber is currently detained at the Cherokee County Detention Center on $145,000.00 secure bond for the following charges: FAIL REPRT NEW ADDRESS-SEX OFF, EXTRADITION/FUGITIVE OTHER STATE, RESISTING PUBLIC OFFICER, BREAKING OR ENTERING, FINANCIAL CARD THEFT, BREAK OR ENTER A MOTOR VEHICLE, FAILURE TO APPEAR ON FELONY. Barber has a December 12, 2021 Cherokee County District Court date.

As you can see we have recognized for some time that monitoring and administering the Sex Offender Registry in Cherokee County is a large task and have partnered with State and Federal Agencies to ensure outcomes like with Barber, who not only is suspect in violations of the Sex Offender Registry but is suspect in several other crimes, not only in Cherokee County and Western North Carolina but out of state as well. Outstanding work by all involved.”
